Commonly, criminal cases follow a specific process, which may include:
Most criminal cases will likely be resolved by entering a plea to some lesser charge(s). Oftentimes, it is possible to get a sentencing commitment from the Judge before you agree to the plea bargain to ensure that that no jail time will be imposed at sentencing. Still other plea bargain agreements do not result in jail time, for example: ACD (adjournment in contemplation of dismissal) –An ACD means your case gets dismissed following six months to a year of no further violations of the law.
Hiring an attorney familiar with Motion Practice may be vital to resolving your case favorably. There are times when an attorney can file a motion with the Court to dismiss your case outright and avoid a conviction because of a Constitutional violation.
In cases that are not resolved by plea bargain or dismissal your case will be set for trial. Defendant’s may opt for a bench Trial in which a Judge hears and decides the case or may request a trial by jury.
Upon conviction of a crime, either by trial or by plea, the judge will impose a sentence. In advance of sentencing, the probation department will do a PSI (pre-sentence investigation) and make an appropriate recommendation to the Court regarding whether a jail/prison sentence is required. Pease note, the judge is not required by law to follow this recommendation.
The first step in developing a strong criminal defense strategy is to start immediately and to hire an experienced attorney. The LFKF will vigorously present your defense for essentially all types of charges including, but not limited to the following:
